Kash Card Terms & Conditions

Please take the time to read this Agreement before using your Kash Card powered by Webcash (“Card”) as this Cardholder Agreement is binding on you upon usage. This Cardholder Agreement is also available at ( www.kash.my ) Please read the Product Disclosure Sheet in Appendix I of this Agreement. You can also refer to our Frequently Asked Questions (FAQ) available at www.kash.my

Webcash (www.webcash.com.my) is an e-wallet Service provided by Webonline Dot Com Sdn Bhd (510377-P) approved under the Payment System Act 2003.

Kashcard ( www.kash.my ) is a Webcash and eFinite Value Sdn Bhd (916653-K) partnered co-branded Prepaid Payment card to allow cashless payment at participating Merchants.

CARDHOLDER AGREEMENT

IMPORTANT! You must read the Terms & Condition before using your Card issued by Webonline Dot Com Sdn Bhd (510377-P) and eFinite Value Sdn Bhd (916653-K). By using the Card, you confirm that you have read and understood and accept the Terms and Conditions set out below and will be bound by them.

A. Acceptance of this Agreement

1.  The Card can only be used by the person to whom the Card is issued (“the Cardholder”), failing which any unauthorised usage will be borne by the Cardholder. The Cardholder must immediately activate the card by registering via online entering all his personal details. For quick activation, registration can be done via SMS giving personal details.

Cardholder must sign the Card upon receipt thereof. Upon activation an e-wallet will be created which acts as the cardholder’s account (“e-wallet”). The Cardholder is treated as agreed to be bound by this Agreement upon activation of the Card and usage of the Card is subject to this Agreement. If the Cardholder does not wish to be bound by this Agreement, the Cardholder must observe Clause 12(a) below.

B. Definitions

2. The terms used in this Agreement shall bear the following definitions:

(i) “Onetime Fee” means the pre-determined onetime fee payable by the Cardholder for each Card and e-wallet activated by the company by means of deduction from the initial value of the card. The onetime fee can be changed without prior notice.

(ii) “Balance Transfer” means the facility of transferring your prepaid balance to another Cardholder.

(iii)“Company” means eFinite Value Sdn Bhd (916653-K) and Webonline Dot Com Sdn Bhd (Company No. 510377-P)

(iv)“Card Account” means an e-wallet account maintained by Webonline branded as WEBCASH corresponding to the relevant Card issued.

(v) “Card Statement” means the transaction statement issued by WEBCASH for the Card Account which is accessible via www.kash.my.

(vi) “Card Transactions” means all Retail Transactions, online transaction and of all Balance Transfers.

(vii) “Cardholder” means the person to whom the Card is issued which is attached to an e-wallet.

(viii) “Current Balance” means the amount of Prepaid balance available in the e-wallet.

(ix) “Personal Identification Number (PIN)” means a number code assigned by the WEBCASH or determined by the Cardholder to enable the Cardholder to avail to certain services related to the usage of the Card. The PIN for the Card will be issued and delivered to the Cardholder at the Cardholder’s own risk. The PIN is strictly confidential and should not be disclosed to any person under any circumstance or written down, failing which any unauthorized usage will be borne by the Cardholder.

(x) “Retail Transactions” means all purchases of goods or services charged to the Card, excluding all Transfers.

C. Usage of Card

3. The Card is the property of the Cardholder. There will not be any maintenance charged to the user other then the one-time activation fee refer to para 7.

4. The Cardholder remains solely liable for the use of the Card and must take reasonable steps to safeguard the Card, failing which any unauthorized usage of the Card will be borne by the Cardholder subject to Clause 13 below.

5. (a) The Card e-wallet Account statement can be accessed via www.kash.my, where it will reflect all Card Transactions, fees and charges incurred in relation to the corresponding Card.

(b) (i) The Cardholder agrees not to use the Card for or in connection with any unlawful activity or purpose (including without limitation online gambling).

(ii) Breach of Clause 5(b)(i), may result in WEBCASH rejecting payments for the affected transactions and terminating the Card immediately, without any liability on WEBCASH.

(iii) Notwithstanding Clause 5(b)(ii), the Cardholder continues to be fully liable to pay WEBCASH the amount due in respect of the affected transactions, if any, and will not use this as a defense to refuse payment of amounts due to WEBCASH.

D. Your e-wallet purse value and Top-up Made To Card Account

6. (a) Card holder can top-up their Card account by:

(i)  Your e-wallet account purse value should not exceed RM200

(ii) Via Online top-up option available at www.kash.my using your Internet bank account from participating banks or your credit card. All bank charges or credit charges will be borne by you.

(iii) Via over the counter at the participating merchants outlets.

E. One-time card activation fee

7. The Cardholder agrees to pay the Onetime Fee for the Card. This Onetime Fee shall be determined and/or varied by Kashcard or WEBCASH from time to time. The fee and charges imposed will be made available at www.kash.my at all times. The Onetime Fee will be deducted from Cardholder initial prepaid value upon activation of the card via online or SMS.

F. Liability vis-à-vis Cardholder and Merchant

8. (a) Kashcard and WEBCASH is not liable for any act or omission of any merchant establishment including any refusal to honor the Card, or any defect or deficiency in any goods or services supplied to the Cardholder by such merchant.

(b) The Cardholder shall resolve all complaints, claims and disputes against the merchants directly and the Cardholder agrees not to involve Kashcard / WEBCASH in any such claims, disputes or legal proceedings.

(c) Any claims and/or disputes which the Cardholder may have against the merchant establishment shall not relieve the Cardholder of the obligation to pay the amounts due to the Kashcard / WEBCASH.

G. Loss or Theft of Card and Disclosure of PIN to Unauthorised Persons

9. (a) In the situation of a loss or stolen Card, the Cardholder’s liability for the disputed Card Transactions is limited to the maximum amount of RM50.00 per card if the following conditions are met:

(i) The Cardholder has not acted fraudulently or was grossly negligent or facilitated the fraud or the loss/theft of the Card, whether directly or indirectly; and

(ii) The Cardholder has informed Kashcard / WEBCASH immediately after having found the Card to be lost or stolen or when the Cardholder suspects that an unauthorised transaction has been conducted using the Cardholder’s Card Account.

(b) To facilitate the Kashcard / WEBCASH investigating into any report of lost or stolen Card, Kashcard / WEBCASH will require the assistance of the Cardholder to perform the following:

(i) Notwithstanding that the Cardholder may have lodged a verbal report, Kashcard / WEBCASH will require the Cardholder to complete a written report, which may include the completion of a questionnaire; and

(ii) To provide Kashcard / WEBCASH with a copy of a police report filed in relation to the loss or theft of the Card.

(c) Pending the completion of the investigation, the Cardholder will continue to be liable for the disputed Card Transactions.

Kashcard / WEBCASH will refund the value of the disputed Card Transactions and any payment received where the outcome of the investigation shows that the conditions under clause 9(a) above have been met.

(d) Notwithstanding the above, the limitation of liability does not apply to situations where the disputed transactions were performed as a result of the Cardholder having disclosed the PIN for the Card(s) to another person. The Cardholder shall act in good faith, exercise reasonable care and diligence in keeping the PIN in secrecy. For example, the Cardholder should not:

Write or otherwise record the PIN in a way that can be understood by someone else;

Tell the PIN to someone else including, without limitation, Kashcard / WEBCASH’s employees and any third parties providing account aggregation services;

Keep any advice from Kashcard / WEBCASH concerning the PIN promptly after receipt;

Use a PIN which may be easy to guess such as birthdays, telephone numbers, dates of birth etc;

Use the same PIN without regularly changing it;

Use PIN from other internet sites.

At no time and under no circumstances shall the Cardholder disclose the PIN to any other person.

10. Kashcard / WEBCASH are not obliged to issue a replacement Card to the Cardholder following its loss or theft.

Any replacement Card is subject to a replacement fee applicable at the time of such replacement.

H. Termination or Closing Your Account

11 (a) You can close your account at any time by clicking the Close Account link in your profile on the Kashcard website. When an account closes, any pending transactions will be cancelled.

(b) Any funds that we are holding for you at the time of closure, less any applicable fees, will be paid to you by cheque, assuming all withdrawal-related authentication requirements have been fulfilled (for example, you may not use closure of your account as a means of evading withdrawal limits on new unverified uses). You cannot use closure of your account as a means of evading investigation: if an investigation is pending at the time you close your account, Kashcard / WEBCASH may continue to hold your funds for up to 180 days as appropriate to protect Kashcard / Webcash against the risk of claims or disputes.

(c) If you are later determined to be entitled to some or all of the funds in dispute, Kashcard / Webcash will release those funds to you. You will remain liable for all obligations related to your account even after such account is closed.

If you do not access your account for a period of two years, it will be terminated. After the date of termination, we will use the information you provided to try to send you any funds that we are holding for you. Failing which it will be reported under the Unclaimed Monies Act and a RM3 yearly charge will be imposed.

I. Cardholder’s Obligations

12.  The Cardholder is to update their account profile at�www.kash.my�of any changes in:

employment or business; or

his/her office or residential address;

J. Service and Notification

13. The Cardholder hereby irrevocably consents any notices under this Agreement, other than service of a notice of demand and of any court process:

by ordinary mail to the Cardholder’s address last known to Kashcard / WEBCASH. Such service shall be deemed to be effective three (3) days after the date of posting even though it is later returned undelivered; or

by electronic mail via internet to the Cardholder’s electronic mail address last known to �Kashcard / WEBCASH or internet mailbox with Kashcard / WEBCASH. Such service shall be deemed effective on the next day after transmission by Kashcard / WEBCASH; or

by posting a notice onto the Kashcard / WEBCASH’s public website or any of its branches.

For any service of notice of demand and service of any legal process, the Cardholder hereby irrevocably consents to the service by registered post (not being AR registered post) to the Cardholder’s address last known to Kashcard / WEBCASH. Such notice shall be deemed to be good and sufficient service three (3) days after the date of posting even though it is later returned undelivered.

K. Modification and Variation

14.(a) The Cardholder agrees that Kashcard / WEBCASH has the right to vary, add to or delete any of these Terms and Conditions from time to time. Kashcard / WEBCASH shall, before the effective date of such changes, give the Cardholder at least 21 days notice of any such alterations which will be published at our website and publish the change in any manner considered appropriate or as required by the regulatory bodies/agencies.

The Cardholder agrees that he/she will be bound by such alterations and if the Cardholder does not agree with such alterations or amendments, the Cardholder must terminate the use of the Card before the effective date of any such alterations or amendments in accordance with Clause 11 above.

(b) The Cardholder’s retention or use of the Card after the effective date of any change of Terms and Conditions is deemed acceptance of such changes without any reservation by the Cardholder.

K. Modification and Variation

14.(a) The Cardholder agrees that Kashcard / WEBCASH has the right to vary, add to or delete any of these Terms and Conditions from time to time. Kashcard / WEBCASH shall, before the effective date of such changes, give the Cardholder at least 21 days notice of any such alterations which will be published at our website and publish the change in any manner considered appropriate or as required by the regulatory bodies/agencies.

The Cardholder agrees that he/she will be bound by such alterations and if the Cardholder does not agree with such alterations or amendments, the Cardholder must terminate the use of the Card before the effective date of any such alterations or amendments in accordance with Clause 11 above.

(b) The Cardholder’s retention or use of the Card after the effective date of any change of Terms and Conditions is deemed acceptance of such changes without any reservation by the Cardholder.

L. Disclosure of Personal Data

15.(a) The Cardholder is required to supply Kashcard / WEBCASH personal data where requested, to enable Kashcard / WEBCASH to consider whether to provide or continue to provide Card related services and failure to do so may result in Kashcard / WEBCASH’s inability to provide or continue to provide such services, without any obligation or liability on Kashcard / WEBCASH’s part.

(b) Kashcard/Webcash will seek Cardholder approval that Kashcard / WEBCASH may use, disclose, transfer, compile, match, obtain and/or exchange (all whether within or outside Malaysia) the Cardholder’s personal details and information, all details and information pertaining to the Card Account and any of the Cardholder’s transactions and dealings with or through Kashcard / WEBCASH (collectively, “Personal Data”) to, from or with any person as Kashcard / WEBCASH may consider necessary including without limitation,

(i) any member of  Webonline Dot Com Sdn Bhd or eFinite Value Sdn Bhd staff which:

(ii) Provides group management oversight of Kashcard / WEBCASH and/or global and regional support, or

(iii) carries on business within the financial services industry, or (iii) is a provider of services to other members of Webonline Group or eFinite Value Group;

(c) any credit bureaus or agencies established or to be established by Bank Negara Malaysia or any of its subsidiaries, or by any other authorities;

(d) any debt collection agencies that may be appointed by Kashcard / WEBCASH for any and all purposes, including without limitation:

in connection with any account, product or service and/or in connection with matching for whatever purpose (whether or not with a view to taking any adverse action against the Cardholder) any such Personal Data with the Personal Data concerning the Cardholder in Kashcard / WEBCASH’s possession; and/or

for the purpose of promoting, improving and furthering the provision of other services by Kashcard / WEBCASH and any member of Webonline Group or eFinite Value Group to the Cardholder generally; and/or

• for the purposes of fraud or crime prevention, audit and debt collection and in order that services may be processed for Kashcard / WEBCASH; and/or

• for purposes of investigating, reporting, preventing or otherwise in relation to money laundering, terrorist financing and criminal activities generally; and/or

for purposes of any legal process initiated by or served on Kashcard / WEBCASH, whether or not Kashcard / WEBCASH is a party; and/or

any other purposes and to such persons as may be in accordance with Kashcard / WEBCASH’s general policy on disclosure of Personal Data as set out in statements, circulars, notices or other terms and conditions made available by Kashcard / WEBCASH to the Cardholder from time to time.

The Cardholder understands that Kashcard / WEBCASH, or any member of the Webonline or any third party to whom the Kashcard / WEBCASH has transmitted information about the Personal Data, will be obliged to disclose such information if legally compelled to do so (whether by Malaysian law or the law of any jurisdiction to which such information is transmitted). Kashcard / WEBCASH may transfer the Personal Data outside Malaysia.

Other countries may not provide the same level of protection for data as Malaysia. However, all Personal Data held by the Webonline or by its sub-contractors or agents will be accorded a high level of protection against any unauthorized or accidental disclosure, access or deletion. The Cardholder agrees and consents to the Personal Data being used as described and that it may be disclosed and/or transferred as stated in this clause.

Kashcard / WEBCASH may use, analyse and assess information held about the Cardholder and the Card Account, including the nature of the Cardholder’s transactions, to give the Cardholder information about products and services Webonline and those of selected third parties which Kashcard / WEBCASH thinks may interest the Cardholder via telephone, mobile phone, electronic media, post or other means. Kashcard / WEBCASH may pass this information to other members of Webonline or efinite Value so that they may do the same unless the Customer has objected to such disclosure for purposes of cross-selling.

Depending on the type of data, including but not limited to Personal Data and information pertaining to the Card Account, and where it is held, the Cardholder may be entitled to request details (including copies) of the information that Kashcard / WEBCASH holds about the Cardholder and to require Kashcard / WEBCASH to correct any inaccuracies. Kashcard /

WEBCASH may charge a fee for the provision of any data. Requests for further information should be addressed to:

M. Indemnity

16.(a) The Cardholder agrees to indemnify Kashcard / WEBCASH against any liability for loss, damage, costs and expenses (legal or otherwise including costs on a solicitor and client basis), which Kashcard / WEBCASH may incur by reason of the provisions herein or in the enforcement of its rights.

(b) Subject to Clause 11, the Cardholder shall upon demand pay to Kashcard / WEBCASH all legal costs, charges and expenses which Kashcard / WEBCASH may incur in enforcing or seeking to enforce this Agreement or in obtaining or seeking to obtain payment of all or any part of the monies owing by the Cardholder.

(c) This indemnity shall remain in full force and effect even after termination of the Card in accordance with Clause 11 above.


N. Disclaimer

17. Kashcard / WEBCASH shall not be liable for any loss, injury or damage howsoever arising including consequential and economic loss suffered by the Cardholder, as a result of:

(i) Card Transactions being rejected due to a “Card Referral”, ‘Card Block” or ”Card Declined” Status placed on the Card by Kashcard / WEBCASH, as a security measure;

(ii) Mechanical defect or malfunction of Kashcard / WEBCASH’s terminal at Kashcard / WEBCASH Merchants

(iii) Failure of the Card;

(iv) The usage of any service offered in relation to the Card;

(v) Any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure in connection with the usage of this Service, even if Kashcard / WEBCASH, its officers, servants, employees, representatives and/or agents are advised of the possibility of such damages, losses or expenses;

(vi) By any circumstances beyond Kashcard / WEBCASH’s control or by strikes or other labour disputes.

18. In the event there are disputes on transaction(s) performed with the Card, Kashcard / WEBCASH has the discretion to decide whether or not to effect a temporary refund and/or counterfeit refund of prepaid value to the Cardholder pending further investigation by Kashcard / WEBCASH with the merchants, Cardholder bank and/or any other relevant parties. Where the merchants, Cardholder bank and/or relevant parties are able to prove with sufficient evidence that the disputed transaction(s) was/were genuinely incurred and/or participated by the Cardholder, Kashcard / WEBCASH has the right to reverse the temporary prepaid top-up or posted.

O. Authorisation or Instructions via Mail, Telephone, Internet, Telex and Facsimile

19.(a) The Cardholder authorizes Kashcard / WEBCASH to rely upon and act in accordance with any notice, instruction demand or other communication that may be given by telephone, telex or facsimile transactions by the Cardholder or on his/her behalf (“Instruction”) and Kashcard / WEBCASH shall be entitled to treat the Instructions as fully authorized by the Cardholder and Kashcard / WEBCASH shall be entitled to take such steps in reliance upon the Instruction as Kashcard / WEBCASH may consider appropriate.

(b) Kashcard / WEBCASH under terms of this authorization is not obliged to accept and act upon the following Instructions:

Change in Mandate

Change to authorized signatories

Power of Attorney to another person/entity

Closure of the account(s) and transfer to the remaining balance by any means

20. Subject to Clauses 19, any request by mail, telephone or facsimile or online transactions including without limitation, made by the Cardholder to a merchant or a provider of any services for the supply of goods and/or services to be charged to the Card Account shall constitute authority:

(i) for the merchant or the provider of services to issue a sales voucher for the amount to be charged;  and

(ii) for Kashcard / WEBCASH to debit the Card Account with such amount charged.

Kashcard / WEBCASH shall take all reasonable steps to verify the identity of the person or persons giving the instructions.

P. SMS Enquiry Service

21.(a) Kashcard / WEBCASH’s Short Messaging System (SMS) Enquiry Service (“Service”) is an option open to all existing Cardholders except for the following category of persons:

(i) Holder(s) of invalid or cancelled Card(s).

(b) The Service involves the following details being sent to the Cardholder’s mobile phone, on request by the Cardholder:

Account outstanding balance and available prepaid value (balance as at request Date)

The available Reward Points for redemption.

(c) The Cardholder must provide Cardholder’s following details:

Card account number, and

Password or PIN number.

(d) The Cardholder must use the same mobile phone number registered for the Service. Cardholders are required to re-register if there are changes in mobile phone number.

(e) Error/reject messages will be sent to the Cardholders under the following circumstances:

Unsuccessful registration

Invalid IC/Passport format (i.e. non-numeric) received

Unidentified keywords received

Cardholders have not registered for the Service, or

Others

(f) By using this Service, the Cardholder hereby expressly agrees to be bound by these Terms and Conditions and consents to Kashcard / WEBCASH disclosing their information and particulars to all third party service providers engaged by Kashcard / WEBCASH for the purpose of the Service.

(g) The Cardholder also authorizes Kashcard / WEBCASH to send to his/her mobile phone, as registered by the Cardholder, their Card prepaid balance; any alerts and marketing promotions relating to Kashcard / WEBCASH’s products and services. This authorization shall remain in full force and effect until an authorized officer of Kashcard / WEBCASH receives written notice of termination of the Service and/or the Card Account from the Cardholder.

(h) The Cardholder should send a message via SMS to “33555 ” with the following details:

  • Kash ACT = Kash Card Activation
  • Kash PIN = Kash Card Change PIN
  • Kash TFR = Kash Card Transfer
  • Kash BAL = Kash Card Check Balance and points balance
  • Kash LMADD = Kash Card LinkMe add by Master
  • Kash LMREM = Kash Card LinkMe remove by Master
  • Kash LMOUT = Kash Card LinkME out by supplementary
  • Kash REPLACE = Kash Card Replacement
  • Kash ATM = Kash Card Top-up via Cash Deposit Machine

All Card outstanding balance as advised by Kashcard / WEBCASH via the Service is accurate at the point of transmission of the SMS by the Kashcard / WEBCASH.

(i) All telephone and other charges incurred by the Cardholders in relation to all SMS enquiries shall be borne by the Cardholders. A fee of RM0.30 per SMS will be charged to the Cardholders by the network operators for every SMS sent by Kashcard / WEBCASH to the Cardholders in relation to the Service.

(j) Kashcard / WEBCASH’s decision pertaining to any enquiry and dispute received shall be final and no correspondence will be entertained.

(k) Kashcard / WEBCASH has the right to cancel, terminate or suspend the Service after giving reasonable notice to the Cardholder.

Q. General

22. This Agreement is governed by and construed in accordance with the laws of Malaysia and applicable directives of regulatory bodies/agencies.

23. Any term or condition in this Agreement which is unenforceable shall not affect the remaining terms and conditions.

1. What is this product about?

This is an e-Money instrument or also called e-wallet, which contains the monetary value which has been pre-loaded or prepaid by the user. The value will be deducted from the amount stored in the e-wallet at the server. The card is used to authenticate whenever purchases are made. You are required to pre-load your account before using the card to make purchases. This E-Money instrument is co-branded with e-Finite Value Sdn Bhd (916653-K) hence, purchases can only be made at participating outlets which accepts Webcash or Webcash Kash as a payment.

2. What are the fees and charges I have to pay?

You only have to pay the onetime activation fee which is published on the website

3. What are my obligations?

Your obligation is to update their account profile at www.kash.my of any changes in:

employment or business; or

his/her office or residential address;

4. What are the fees and charges I have to pay?

Annual fee;. No annual fee is imposed

Joining fee; if any; you will only be charged a activation fee.

Cash advance or withdrawal fee; There will be a RM3 charged

Card replacement fee; The Cardholder will need to purchase a new card and the activation fee is applicable

Overseas transaction conversion fee; at the moment the card is only usable in Malaysia

Fund transfer fee; There will be a RM0.50 fee charged for any transfer done between users except for Linkme users.

. SMS fees; The Cardholder can make SMS request to e.g. check balance, Linkme activation/deactivation and other functionality, telco charges apply.

5. What if I fail to fulfil my obligations?

Your card will be blocked and money will be refunded as per the refund policy

6. What are the major risks?

There is no major risk because this is a prepaid card as such your money is stored in a secured location. However please ensure you do not share any PIN or password.

7. What do I need to do if there are changes to my contact details?

It is important that you inform us of any change in your contact details to ensure that all correspondences reach you in a timely manner. You can update your profile at www.kash.my
